When Truck Driver Fatigue Causes An Accident

Injured in an accident caused by a truck driver who was too tired to be behind the wheel? Discuss your legal options in a free consult with an experienced Dallas attorney. Call 214-646-6688.

Truck drivers often have the incentive to make their deliveries in as quick a time as possible. Despite federal regulations, far too many truck drivers spend far too much time on the road without taking their required breaks.

Federal hours of service laws specify that a driver is not to spend:

  • 11 or more hours in a consecutive 14-hour period following 10 consecutive off-duty hours
  • More than 14 hours of driving in a 24-hour period
  • Logging more than 60 hours in a seven-day consecutive period
  • Logging more than 70 hours in an eight-day consecutive period

“Although a driver can be charged with criminal violations for breaking federal trucking regulations, the civil justice system is the best way we have for holding negligent parties accountable. The driver and the truck company owner may be held liable for compensating you for your injuries or the death of your loved one. Don’t talk to a truck company representative or insurance adjuster until you have an experienced lawyer on your side.” Attorney Jason January
